1. PURPOSE OF THIS POLICY:
This Driver Conduct & Incident Response Policy (“Policy”) establishes clear standards of conduct for drivers connected through Scorpio Five Star Car & Limo Service Inc. (“Scorpio”) and outlines the procedures Scorpio follows when safety concerns, complaints, or incidents are reported.
The purpose of this Policy is to promote passenger safety, set professional expectations, and ensure that concerns are addressed promptly and responsibly. This Policy applies to all drivers who receive trip referrals or bookings through Scorpio, regardless of how they are classified or engaged.
Nothing in this Policy creates an employment relationship, agency relationship, or guarantee of safety.
2. SCORPIO’S ROLE:
Scorpio operates as a booking and service coordination company. Scorpio does not provide transportation services, does not operate vehicles, and does not supervise rides in real time.
Drivers remain solely responsible for their conduct, compliance with law, and operation of their vehicles at all times. This Policy reflects reasonable safeguards and response procedures and is not a promise that all risks can be eliminated.
3. DRIVER CONDUCT STANDARDS:
Drivers are expected to conduct themselves professionally and lawfully at all times while providing transportation arranged through Scorpio. Drivers must not engage in any conduct that endangers passengers, including but not limited to:
a. Sexual misconduct, sexual assault, harassment, or inappropriate physical contact,
b. Verbal harassment, intimidation, or threatening behavior,
c. Discrimination based on any legally protected characteristic,
d. Retaliation against a passenger for raising a concern or complaint,
e. Driving while impaired by alcohol, drugs, or any substance,
f. Carrying unauthorized weapons or engaging in illegal activity
Drivers are expected to respect personal boundaries, maintain appropriate communication, and follow all applicable laws and regulations.
4. DRIVER REPORTING OBLIGATIONS:
Drivers have an ongoing obligation to report matters that may affect passenger safety or eligibility to receive trip referrals. Drivers must promptly notify Scorpio if they:
a. Are arrested, charged, or convicted of a criminal offense involving violence, sexual misconduct, or endangerment,
b. Become aware of allegations or complaints involving misconduct during a ride,
c. Are involved in an incident that could reasonably raise safety concerns,
Failure to report required information may result in immediate removal from access to Scorpio’s booking or coordination services.
5. PASSENGER COMPLAINT INTAKE:
Scorpio provides passengers with the ability to report safety concerns or misconduct through designated phone numbers or email addresses.
When a complaint is received, Scorpio will:
a. Document the report,
b. Escalate serious allegations promptly,
c. Preserve relevant records where appropriate.
Passengers are encouraged to contact emergency services directly if they believe they are in immediate danger.
6. IMMEDIATE RESPONSE PROCEDURES:
When Scorpio receives a credible report of serious misconduct or a safety-related incident, Scorpio may take immediate action, which can include:
a. Temporarily suspending a driver’s access to trip referrals,
b. Notifying appropriate internal personnel,
c. Cooperating with law enforcement or insurers when appropriate.
Temporary suspension during review does not constitute a finding of fault and is intended to protect all parties while information is assessed.
7. INVESTIGATION AND COOPERATION:
Drivers are expected to cooperate fully with reasonable requests for information related to complaints or incidents, including cooperation with internal review processes, insurers, and law enforcement where required.
Scorpio does not conduct criminal investigations and does not make determinations regarding guilt or innocence. Decisions regarding continued access to booking services are based on safety considerations, policy compliance, and available information.
8. RESOLUTION AND ENFORCEMENT:
Based on the nature of the incident and information available, Scorpio may take actions including:
a. Permanent removal of a driver from access to Scorpio’s services,
b. Continued suspension pending resolution of external proceedings,
c. Other actions deemed necessary to protect passengers and the integrity of services,
Scorpio reserves sole discretion to determine whether a driver may continue to receive trip referrals.
9. RECORD HANDLING AND CONFIDENTIALITY:
Information related to complaints and incidents is handled with care and shared only as reasonably necessary for safety, legal compliance, insurance, or response purposes.
Records are retained in accordance with applicable legal, insurance, and operational requirements.
10. NO GUARANTEE OF SAFETY:
Scorpio takes reasonable steps to promote safety, but no policy, screening process, or response procedure can eliminate all risk.
This Policy does not guarantee passenger safety and does not replace the driver’s independent responsibility for lawful and appropriate conduct.
11. POLICY UPDATES:
Scorpio may update this Policy from time to time to reflect operational changes or evolving legal considerations. Updated versions apply going forward.
12. ACKNOWLEDGMENT:
Drivers receiving trip referrals through Scorpio are expected to review and comply with this Policy as a condition of continued access to Scorpio’s booking and coordination services.
